MINUTES

6/03/03

The Cedar Creek Board of Trustees met in regular session at 7:00 p.m., on June 3, 2003, at the Village Hall. Board members were present: Bode, Stauffer, Muntz,. Absent: Rydl, Swenson. Advanced notice of the meeting was given by posting in the village and by publication in the Plattsmouth Journal.

Motion by Stauffer, second by Muntz, to approve the minutes of the 5/06/03 meeting. All ayes.

Motion by Muntz, second by Stauffer, to approve the treasure's report and pay all claims. All ayes.

POLICE REPORT:

No officer present. Written report to the board recorded 72.86 hours of patrol logged for Cedar Creek during the month of May. Three calls for service were made: Traffic/Other, Accident/Car Deer, Disturbance/ Load Party.

CORRESPONDENCE:

Letter to all customers from Otoe County Rural Water District #3.

Information from the Nebraska Department of Roads on the Transportation Enhancement Program. Intent to file form will be submitted.

League Association of Risk Management loss detail notice received.

REPORTS OF OFFICERS, BOARDS, AND COMMITTEES:

Gene Stauffer reported the Pavilion is to be completed in time for Cedar Creek Day; OPPD will be contacted and requested to extend power to the pavilion; Waste Management will be contacted on availability of recycled picnic tables for the park. The park committee is also planning on building tables; Plans for Cedar Creek Day are ongoing. Additional volunteers are needed, sign-up sheets are at the Post Office and the Village Hall, or individuals may call the Village Office at 234-7856. Motion by Stauffer, second by Muntz, to close B Street from Walnut Street to the Park on June 28, 2003, from 12:00 noon to 12:30 p.m. for the Cedar Creek Day Parade, and to close B Street from Walnut Street to Olive Street on June 28, 2003, from 12:30p.m. to 2:00 p.m. for the Fire Department Water Fight during Cedar Creek Day. All ayes.

UNFINISHED BUSINESS:

A proposal was received from Jeff Leach to patch village streets at $18.00 per hour working as an independent contractor. Motion by Stauffer to accept the submitted proposal from J. Leach, and allow J. Leach use of village equipment during the work. Second by Muntz. All ayes. Cold patch ordered and stored in three locations. Work to be reviewed at the July meeting. Cass County Department of Roads will be contacted in regard to NE Statute 17-508.01which allows a village to contract with the county for street maintenance. Tabled to July.

One application was received for part time summer maintenance. The board sees no need for an additional employee at this time.

It was reported, the Platte River Dike needs additional tree removal and needs additional rip-rap added due to erosion. The Corp of Engineers will be contacted and requested to extend the previous permit.

Discussion of regulatory signs tabled to July.

MISCELLANEOUS BUSINESS:

An Appeal of Decision to the Board of Adjustments, was filed by Theresa Metzger in regard to the Trustees denial of a Conditional use Permit for a Paintball Course and Shop at 18605 114th St. Attorney Reinsch informed the board, the Comprehensive Development Plan as written by JEO, changed the ordinance for a Board of Adjustments. AS a result, Cedar Creek currently does not have a board of Adjustments. Several alternative solutions were discussed. Following the regulations of the Comprehensive Development Plan, motion was made by Stauffer, second by Muntz, to form a Cedar Creek Board of Adjustments with members being: Gene Stauffer, Dan Muntz, Dave Rydl, Bill Swenson, Jeff Leach, and as alternate Gwen Bode. All ayes. At the recommendation of B. Reinsch, the Board of Adjustments will meet after the Trustee's meeting to decide on a date and time for a Public Hearing to hear the appeal of T. Metzger.

NEW BUSINESS:

At the request of the Board, Attorney Reinsch will contact the Cable Company over non-payment of the franchise fees. Customer problems were heard and discussed.

Complaints have been received on weeds, condition of properties, dead trees, all terrain vehicles, and golf cart. Individual property owners who are in violation of Village Code will received notice by mail. Interpretation of State and Local regulations pertaining to ATV's differ. The county sheriff will be requested to explain the regulation at the July meeting. Several pine trees in the village have died. The trees will be inspected and if diseased will be removed.

A letter was received from Sarpy/Cass County Department of Health and Wellness notifying the board of a complaint from an individual on the condition of private and public property along Platteview Drive from the storage units to the west end of Lake #2. The complaint indicated the property was being used as a dumping ground for hazardous material, glass, tires, debris, appliances, trash, and building material. The Village Clerk and Gene Stauffer both informed the Department, the accusations were false. The area will be check for illegal dumping and monitored. All noxious weeds will be sprayed and removed.

An individual inquired if the Village would be interested in hiring a dog catcher for the village. The Board requests the individual attend a board meeting to discuss the proposal. Item Tabled.

PERMITS:

Lot #9 Diesel Lake No paper work has been submitted. No action taken.

A Floodplain Development Permit was approved by the Village Floodplain Manager for construction of the Pavilion at the Village Park.

Motion by Muntz, second by Stauffer, to adjourn the meeting of the Board of Trustees and to convene as the Board of Adjustments. All ayes. Time 8:00 p.m.

The Board of Adjustments meeting was called to order at 8:00 p.m. Present; Stauffer, Muntz, Bode. Absent; Rydl, Swenson, Leach. Decision made to hold a Public Hearing on April 12, 2003. at 7:00 p.m., at the Village Hall to hear the appeal of Theresa Metzger on the Trustees decision to deny a Conditional Use Permit for a Paintball Course and Shop at 18605 114 th Street. Notice of the Public Hearing will be posted in three public places in the village and sent by certified mail to the applicant. Agenda for the hearing shall include hearing from those in favor of the Conditional Use Permit and those opposed to the Conditional Use Permit. A vote of four, will be required to reverse the Trustees decision. Gene Stauffer will serve as Chairman of the Board of Adjustments.

There being no further business to come before the board, motion by Rydl to adjourn, second by Muntz. All ayes.
